I, Nicole Brand, the breeder, warrant that puppy purchased hereunder is and will be of sound health and free of any contagious diseases if discovered within 48 hrs of sale by a licensed Veterinarian of buyers choice. If said puppy is found to be in poor health, as evidenced by a written statement from a licensed veterinarian:
1) Return this puppy to the breeder immediately with a signed written statement & receipt from Veterinarian stating puppy’s poor health, & the breeder will give a full refund of the puppy’s purchase price OR
2) Elect to keep the puppy and assume any and all costs for its care.
Buyer acknowledges that the remedies set forth herein constitute Buyers exclusive remedy for breach of warranty set forth above. All Veterinarian expenses are to be paid by the buyer. After the 48 hr. period buyer assumes all responsibilities for the puppy AND there are NO REFUNDS after that time for above puppy contracting a contagious disease. The buyer agrees to spay / neuter puppy within a period of 6 months from the birth of the puppy, unless otherwise agreed upon between parties at purchase. If you are looking for a puppy to breed, we are more than willing to talk with you about the responsibilities of breeding. We take great care to provide our dogs with a great pedigree and just want to make sure that if our pups will be used for breeding that it will be done with great care and responsibility. Again, feel free to talk with us about this. An additional $100 will be added to the price of the puppy for full breeding rights. Also, buyer agrees to provide annual preventative care including the following: physical examinations, vaccinations, fecal examinations, and rabies vaccinations per the buyer’s state of residence & provide good overall care of the animal.
The buyer also understands Australian Shepherds and Labrador Retrievers are high maintenance and will require exercise on a daily basis & The buyer agrees to provide food, water, proper housing, and adequate exercise on a daily basis. Buyer acknowledges that, if the breeder reasonably believes or has proof that the dog being purchased hereunder is not being taken care of in accordance with the terms set forth herein OR is being abused or mistreated the breeder can repossess this dog at any time. The buyer certifies, by signing this contract, that the puppy will live with the buyer. The buyer agrees to notify breeder before transferring ownership of this dog to anyone. The buyer agrees to notify the breeder immediately if the buyer does not want or cannot keep this dog & he/she agrees to return this dog with all registration papers & transfer, signed by owner, to the breeder for FREE & the breeder will take care of this dog. This contract is made & signed by both the Breeder & the Buyer for the well being of the puppy. This constitutes the complete agreement between the buyer & breeder. No other guarantees or warranties are expressed or implied. The parties agree that the terms set forth herein shall be construed in accordance with, and governed by, the laws of the Commonwealth of Pennsylvania.
SHIPPING COSTS: Buyer agrees to pay the cost of vet check for health certificate, a crate for shipping the puppy in, all airline costs & the all other costs for shipping the puppy, including an additional $150 for the breeder to transport the puppy to the airport. Buyer must have ALL FUNDS, INCLUDING TOTAL PURCHASE PRICE OF PUPPY, $150 transport fee, and ALL SHIPPING and SHIPPING ASSOCIATED COSTS for said puppy PAID IN FULL to Seller/Breeder ATLEAST 21 days prior to ship date. Buyer agrees that if all funds mentioned above are not received atleast 21 days prior to shipping, unless prior arrangements have been made & agreed to in writing by both parties, the Buyer will forfeit all rights to the puppy and the deposit will be retained by Seller/Breeder.
